By accessing, using, or purchasing a subscription to EnergyCalc ("the Service"), you ("User", "you", or "your") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

By purchasing a subscription, you explicitly acknowledge that you have read, understood, and agree to be bound by these Terms and any future modifications.

2. Service Description

EnergyCalc is a software tool designed to assist with energy cost analysis, solar generation calculations, and battery storage optimization for commercial and industrial projects. The Service provides calculators, data analysis tools, and related features.

IMPORTANT: EnergyCalc is a calculation tool only. It does not provide professional advice, engineering services, or guarantees regarding energy savings, project viability, or financial returns.

3. Subscription and Payment Terms

• Subscription fees are $49 USD per month, billed monthly
• Payment is processed automatically on your billing date
• All fees are non-refundable unless required by applicable law
• You may cancel your subscription at any time through your account settings
• Upon cancellation, you retain access until the end of your current billing period
• We reserve the right to modify pricing with 30 days advance notice
• Failure to pay may result in immediate suspension or termination of access

4. Disclaimer of Warranties and Limitation of Liability

No Responsibility for Results

• We make no guarantees regarding the accuracy, reliability, or completeness of any calculations
• Energy savings calculations are estimates only and may not reflect actual results
• You are solely responsible for verifying all calculations and data before making any decisions
• We are not responsible for any financial losses, project failures, or investment decisions
• All calculations should be independently verified by qualified professionals

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, revenue, or business opportunities
• Project failures or cost overruns
• Investment losses or financial damages
• Data loss or system downtime
• Third-party claims or legal issues

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

• Any disputes shall be resolved through binding arbitration
